Terms and Conditions
Objectives:
• The State Technical College of Missouri (referred to herein as “the College”) operates a public golf course and entertainment center to ensure utmost pleasure & enjoyment for all users.
• The College reserves the right to establish guest and membership Rules and Regulations and has the authority to modify and amend these as deemed appropriate.
• All rights, privileges and entitlements are on the basis that members, students, guests and the public will comply with and adhere to the Rules & Regulations as established by the College.
Hours of Operation:
• The golf course and facilities are available for use during established business hours as posted at the entrance of the facility and online at
https://www.statetechmo.edu/campus-life/state-tech-golf-center/.
• The College reserves the right to close the course, facilities, or portions of either during established hours for scheduled maintenance, repairs, outings, or private functions.
Conduct & Behavior:
• Members, students, guests and the general public being afforded access to the facility, are required to act in a responsible and decent manner in any event in accordance with rules and directives as to such conduct as determined by the College.
• As determined by the discretion of the College, any person whose conduct is determined to endanger the welfare, safety, harmony of others or the reputation of the College, or is otherwise improper, may be reprimanded, suspended or excluded from the premises and facilities.
• Each person is to abide by all Rules and Regulations established by the College as related to conduct. These rules may include, without limitations, rules regarding conduct injurious to the operation, the reputation, non-payment of fees and/or charges in accordance with the College terms.
• Each person is to refrain from using abusive language; no harassment of staff members or other guests; no violent behavior, interpersonal confrontations; compliance with stated cart rules; as well as acting respectfully and with reasonable care for the College’s property and equipment.
• Violations of any of the above rules or policies may result in the College’s right to cancel or revoke a member’s benefits for a specified period of time or permanently at the College discretion without negotiation or compensation.
Course Use:
• It will be in the sole and absolute determination of the College to determine when the golf course is open for play.
• Members, students, guests and the general public (collectively referred to herein as ‘‘players’’) are required to observe reasonable rules and criteria in employing and enjoying the golf course facility. The College will from time to time prescribe recommended tee box utilization as to the category and skill level of the Players. The College reserves the right to designate appropriate tee boxes for the level of play that Players demonstrate.
• It is expected that all players, and anyone utilizing the golf course or facility will be required to adhere to the principals of golf etiquette in all respects.
• The general principal is that foursomes have the right of way, despite the fact that there may be twosomes playing the course, they shall not necessarily have the right to priority or to play through. The matter of priority will be based on pace of play being exhibited by respective golfing groups. In any event, it will be in the final determination of the College as to the pace of play and the priority of groups. Furthermore, it will be in the determination of the College as to the size of groups (in other words, the number of players in each group) that will be allowed to play on the course.
• Players may be required to be grouped with other players so as to make up foursomes if such circumstances exist. In any event, the configuration of groups will be in the discretion of the College.
• Groups of five or more players will only be permitted at the discretion and permission of the College.
• Any group missing their tee time will forfeit their place and will have to wait for the next available tee time.
• Practicing on the course is strictly prohibited.
• Players will be required to adhere to general rules associated with actions and activities on the golf course, and ensure that they leave bunkers in a smooth and contoured condition consistent with the intended pattern and contour of the traps. Bunker rakes are to be left near the perimeter of the bunkers, and away from the most likely lines of play.
• Players are required to repair all ball marks on the greens.
• Players are required to repair all divots on the fairways and throughout the course.
• Each player on the course is required to have his or her own set of golf clubs.
• Players and other individuals utilizing the golf course must follow signage set forth throughout the course.
• Golf course maintenance equipment has the right of way at all times.
• It is the objective of the College to encourage a reasonable standard for speed of play, and to minimize and or eliminate slow play. Players are expected to keep up to the group in front of them and adhere to the following:
-Players are expected to adhere to the concept of ‘‘ready golf’’, which means that provided that the other Players in your group will not in any way be endangered by your intended shot, you can proceed, notwithstanding that the other Players may be somewhat further out from the green than you;
-Take a sufficient number of clubs to ensure that you can complete your shot when leaving your golf cart;
-Be ready to putt when it is your turn by making your alignment and determining various other factors while other Players are putting, providing you do not interfere with their putting . . . putt out providing that you are not stepping on or interfering with the line of another player;
-When you have had an inordinate number of strokes on a hole, pick up;
-Assist other Players in determining where their ball has traveled to and provide them with some guidance as to the location;
• Consistently slow players will be encouraged to play quicker and adhere to the general rules of the club regarding pace of play.
• The College will have the authority to expedite play in whatever manner is deemed necessary.
• Players are required to adhere to any direction or advice or recommendation provided by
the College, and Players failing to adhere to such directions will be reported to the club.
Property Damage:
• The College reserves the right to hold persons financially and legally responsible for any patron caused damages involving equipment and/or property owned by the College.
• Any abutting or private property must not be trespassed upon to retrieve a ball or for any other purpose.
• Players are responsible for all damage to private property surrounding or adjacent to the golf course or any of the Facilities.
• In circumstances where a player causes any damage to adjacent property or any of the Facilities, it is the responsibility of the player to contact the property owner (and/or the College) to rectify and/or repair any such damage.
Cart Use:
• The College reserves the right to designate areas on the golf course on which golf carts will be permitted.
• Players afforded access and use of the golf course will be subject to directions and restrictions to where golf carts will be allowed on the facilities, and more particularly on the golf course.
• Golf carts are to be primarily operated on designated paths unless otherwise specified by the College.
• The College will not facilitate or permit privately owned golf carts on its facilities.
• Individuals under the age of 15 are not permitted to operate a golf cart on the facilities unless accompanied by a member.
• Use of a golf cart will be limited to a maximum of two persons and their equipment.
• Golf carts are only to be used on the golf course and designated areas, and not to be driven on public roads.
• Players assume all responsibility for liability connected with the operation of golf carts, and will be required to sign an acknowledgment as to responsibility and liability for matters associated with use and employment of a golf cart prior to being allowed to use a golf cart on the golf course or any of the Facilities.
Booking Tee Times:
• Members can book a tee time up to 30 days in advance of desired day.
• Public players can book up to 14 days in advance during normal business hours either in person, on-line or by telephone.
• Messages left on answering machines or similar devices will not be accepted as proper booking procedure.
• The College will designate member tournaments and/or event days for golfing events, such designated times to be dependent upon utilization of membership. Such designated events will be varied from time to time so as to facilitate membership demand and utilization.
• Tee times are not required to play the course, but are preferred. Walk-ins are welcome, and scheduled based upon available tee times.
Dress Code:
The College will determine and inform members, guests and public from time to time what we accept as proper golf attire. Some basic terms of reference will be as follows:
• Metal spikes are not permitted inside the facility or on the golf course.
• Cowboy boots are not permitted on the golf course.
• Offensive graphics and/or phrases are not permitted.
• Cut-off or sleeveless shirts are not permitted on the course.
• Shirts and shoes are required at all times inside of the facility and on the course.
Food and Beverage:
• No outside food or beverage is allowed on the course or in the facility.
• All food and beverages must be purchased from the College’s driving range, pro shop or restaurant.
• Food and beverages are not allowed inside the simulator bays or in the bowling lanes, and must remain at designed tables.
Tobacco Products:
• The use of tobacco products and electronic delivery devices is prohibited at all times in or on all property the College has the authority to control. This includes the Osage Country Club and the State Tech Golf Center.
Pets
• Except for service animals or approved support animals for persons with disabilities, no pets are allowed (even temporarily) anywhere in or about the facilities or premises without prior written authorization from the College.
Hazardous weather conditions:
• All players are responsible for their own safety during hazardous weather conditions and those who continue to play do so at their own risk.
• The College will attempt to warn users when conditions dictate. Under no circumstances shall the College, the owners, officers, employees, representatives or agents, be held liable for failing to warn users of hazardous weather conditions or the need to vacate the course.
Photography Permission:
• The College may use, without limitations or obligations photography, film footage, or tape records which may include images or voices for purpose to promoting or interpreting the College programs.
Solicitations
• Signs, flyers and other advertisements shall not be posted or circulated at the facilities or premises without written permission from the College.
Personal Property & Personal Injury:
• It has been determined by the College each person shall be solely responsible for his/her property. The College will not be held responsible for any loss or damage to any private property used at the facility or premises.
• Anyone occupying, using or benefiting from any of the facilities may not remove any of the property of the College from the areas without written approval and consent of the College.
• Each person given access to the facilities in any manner, or any of the described individuals that gain use of or accepts the use of any personal property, equipment, facilities or is afforded use and access of any such facilities, or services available through the College, including but not limited to golf carts and any other similar mechanisms used during the course of play, or any other activity undertaken at the Facilities, or in situations where such individuals participate in any activities, functions, competitions or other events on the Facilities, these individuals do so at his or her own risk.
Personal Information:
• Members are required to keep the College informed of any current mailing address, telephone number or E-mail address so we can contact you if an emergency arises, and to provide such notification in writing, or by E-mail to management via the contact information provide at

Guests of Members - Privileges:
• The College will have the right to establish rules applicable to guests of members. Such rules may be modified or varied from time to time so as to best serve members and the interests of the College.
• Privileges attributed to guests may be modified, varied, denied, limited or withdrawn at any time for reasons considered sufficient by the College in its sole and absolute discretion.
• Guests will be entitled to employ and enjoy the Facilities based on the Rules and Regulations that are determined by the College.
• The member shall be responsible for all charges incurred by his or her guests.
• Guests must adhere to standards of conduct and deportment as established by the College. The College shall have the right to determine whether the guest is complying with all Rules and Regulations. If it is determined that a guest does not comply, then the College shall have the right to require that the guest leave the Facilities.
Public Access:
• The College will facilitate the general public gaining access to the Facilities.
• The College will determine the appropriate fees and charges that the general public will be levied in conjunction with the use and benefit of the facilities.
• The general public will be bound by the Rules and Regulations applied to members, along with other further and additional Rules and Regulations that may be applicable to the general public as will be determined by the College from time to time in its sole and absolute discretion.
• The general public will be bound by the Rules and Regulations regarding demeanor, conduct, attire and other similar Rules and Regulations applied to members.
Tournaments & Special Events:
• The College will afford members the right to arrange for tournaments during periods designated by the College. These events will be scheduled by the College in such a manner so as to ensure that the other members are not unduly restricted from access to the golf course. Notwithstanding the preceding, The College reserves the right and entitlement to schedule tournaments and special events towards the advancement and promotion of the golf course facilities.
•Membership acknowledges that the College intends on taking all reasonable measures towards ensuring that the facilities are utilized on consistent basis.
Pool:
• Members, students and guests (referred to herein as “pool patrons”) use the pool facilities at their own risk.
• Members may bring 2 additional guests per person, per day. Guest will be charged at a rate of $7/day.
• Children under the age of 16 are not permitted in the pool area without an adult.
• Pool patrons are responsible for the supervision and care of themselves, their families, and their guests using the pool.
• Children not completely potty trained must wear swim diapers in the pool. No regular diapers will be permitted in the water.
• All pool patrons must check in at the Pro shop before entering the pool area.
• Members must accompany their guests and must pay applicable fees for their outside guests using the pool.
• No outside food, drink, coolers or glass containers of any kind are permitted in the pool area. Restaurant services are available to pool patrons for this purpose.
• Pool staff reserve the right to check baggage if deemed necessary.
• No running, diving or rough play permitted in the pool area.
• No profane or offensive language will be tolerated in the pool area.
• Swimmers and sunbathers must wear appropriate bathing attire at all times.
• Locker rooms are available for bathing suit changes.
• Bathing suits should not be worn in areas outside of the pool. Shirts, shorts, and/or cover-ups and shoes must be worn when entering the facility.
• Pool patrons must be completely dry before entering the clubhouse.
• Cell phones, cameras, or any device with a camera on it may not be used in the locker rooms, bathrooms, or changing areas.
• Pool patrons are responsible for their own belongings. The facility will not be held responsible for lost, stolen or damaged items that are brought into the pool or pool area.
• All infants and toddlers are required to wear swim diapers in the splash pad area.
• All pool patrons are expected to help keep the pool free of litter.
• No animals allowed in the pool. Service animals are permitted on the patio area only.
• Small flotation devices and pool toys will be permitted unless they become disruptive to other guests.
• Headphones must be worn when listening to musical or entertainment devices.
• Persons are not permitted in the pool if they have a cold, cough, fever, infection of any
kind, skin rash, inflamed eye(s), or are wearing bandages.
• The pool and surrounding pool area will be closed during inclement weather. All users are responsible for their own safety in the pool and pool area during hazardous weather conditions. While the staff will attempt to warn users when conditions dictate, under no circumstances shall the College, the owners, officers, employees, representatives or agents, be held liable for failing to warn users of hazardous weather conditions or the need to vacate the pool.
If you choose not to follow any of the above policies you will be asked to exit the facility for the day without a refund. Repeat offenders will have their membership revoked and will not receive a refund for the remaining length of their membership.
ACKNOWLEDGEMENT
I have read, understand, and agree to all of the information under the terms, conditions and policies of this membership agreement. In addition, I understand and agree that the assumption of risk, waiver and release of all claims provisions set forth in the terms and conditions of this agreement are in effect throughout my membership with The College. I also understand and agree that if my membership is interrupted for any reason, this agreement will remain in effect during the period of interruption as well as after the membership is reinstated. This agreement is the entire agreement, and no verbal or other agreements have been made to alter the terms of this agreement.
The member agrees to fully indemnify, defend, and hold the College and its owners, officers, employees, and other agents, harmless from and against any and all liabilities, claims, actions, lawsuits, demands or damages incident to or arising out of acts or omissions of the member, guests, and public.
