The Omnibus Transportation Employee Testing Act of 1991 (OTETA) requires employers to test all safety-sensitive employees who perform safety sensitive functions. These positions include but are not limited to employees or volunteers who are required to possess a commercial driver’s license (CDL).
This policy identifies Commercial Driver’s License (CDL) Instructors and Lab Instructors as safety sensitive positions and are subject to required substance testing.
Required testing is as follows:
Pre-employment testing – Prior to the first time an employee performs any function of a safety sensitive position the employee is required to undergo testing for controlled substances.
Post-accident testing – As soon as practical following an accident of an employee in a safety sensitive position, the employee is required to undergo alcohol and/or controlled substance testing.
Random testing – Annually, employees holding safety sensitive positions will be randomly selected to undergo controlled substance testing. In addition, employees holding a safety sensitive position will be randomly selected to undergo alcohol testing annually. Testing rates will be in compliance with annual requirements set by the Department of Transportation (DOT).
Reasonable suspicion testing – See the Drug-Free and Alcohol-Free Workplace policy.
Return to duty testing – If not terminated after a positive test, the employee must undergo a return to duty alcohol or controlled substance test. Tests must reflect a negative result prior to returning to duty.
Follow up testing – Employees testing positive for alcohol or illegal controlled substance use are subject to follow up unannounced random testing. Follow up testing may be conducted for up to five years with no minimum or maximum testing occurrences.
Compliance with this policy is a condition of employment. Employees tested under this policy who violate the policy or refuse to take a DOT required test are subject to discipline up to and including termination and will be reported to the Department of Transportation.
In the event of ambiguity, State Tech intends this policy to meet the requirements of OTETA and adopts the policies, procedures, and definitions stated in the Act and its supporting regulations, as though stated fully herein.
